Open Burning, Recreational Fires and Portable Outdoor Fireplaces

Open Burning, as defined in Georgia’s Rules for Air Quality (391-3-1-.01(tt)), is any outdoor fire from which the products of combustion are emitted directly into the outdoor air without passing through a stack, or chimney from an enclosed chamber.

All Open Burning is prohibited in the City of Brookhaven. Burning in a barrel or metal drum is prohibited. Burning garbage or rubbish is also prohibited. Should you suspect an open burning violation, please dial 911 to report the possible illegal activity.

Exceptions:

Fires in approved containers that are not less than 25 feet from a structure (this includes combustible decks, sidings, and overhangs) and shall be between 10:00 am and 10:30 pm.  Burning of logs, approved propane and natural gas devices only; lumber or man-made material is not allowed to be burned. 

Types of fire allowed all year: warmth, cooking food for immediate human consumption (BBQ grill or pit), outdoor fireplaces or other similar approved devices following the manufacturer’s specifications, pleasure, or religious ceremonials. A water charged water hose shall be available for immediate use and always attended by an adult. No permit required.

A bonfire shall not be conducted within 50 feet of a structure or combustible materials, or within 100 feet of any property line, and shall be between 10:00 am and 10:30 pm and shall be for ceremonial purposes only.  Burning of logs only; lumber or man-made material is not allowed to be burned.  The maximum size of the bonfire is 3 feet wide by 2 feet in height. A water charged water hose shall be available for immediate use and always attended by an adult. A permit is required for a bonfire and will be approved on a case-by-case basis.

Please note:  Full compliance with all the guidelines for burning may still require the fire to be extinguished if it interferes with someone’s enjoyment of life, use of property, or if someone with a health problem is affected.

The currently adopted International Fire Code, Section 307.3, Extinguishment authority. Where open burning creates or adds to a hazardous situation, or a required permit for open burning has not been obtained, the fire code official is authorized to order the extinguishment of the open burning operation.

Open-flame cooking devices

Charcoal burners and other open-flame devices shall not be kindled on combustible balconies or within 10 feet of combustible construction.

Exception: One- and two-family dwellings

Open-flame cooking devices may not be used within the building, to include inside apartment units, stored in breezeways, balconies/patios, stairways, or exit access areas.
