Elections and Qualifying

The City Clerk is the official record keeper for the City and is appointed by the Mayor and Council. Responsibilities of the City Clerk’s Office include recording and maintaining the Council's official actions in minutes, coordinating and distributing the agenda, maintaining contracts, ordinances, resolutions, and agreements and coordinating the records management and retention program for the City. The City Clerk attests signatures of Mayor and Council and is official keeper of the City seal and affixes its impression on documents whenever required. The City Clerk oversees the adoption and publishing of the Code of Ordinances. The City Clerk is the designated Open Records Officer and helps to ensure that all open record requests are in accordance to the Open Records Act. The City Clerk works and coordinates closely with DeKalb Board of Registration and Elections during elections.

 Open Records/Meetings
The Georgia Open Records Act (O.C.G.A. §50-18-70-77) requires that all city records, except those excluded by court order or by law, be open for personal inspection to any citizen of Georgia at a reasonable time and place. However, there are specific records excluded from the coverage of this law. The City of Brookhaven has procedures in place to ensure that there are adequate review and input by the City Clerk and City’s attorney for inspection requests.

Cities also adhere to the Open Meetings Act (O.C.G.A. § 50-14-1-6), commonly referred to as the Sunshine Laws. The Sunshine Laws provide stipulations and regulations pertaining to public meetings. The Open Meetings Act also provides specific exceptions to the general requirement that meetings be open,

 Elections and Qualifying
According to State Law O.C.G.A. § 21-2-9(b), and the City Charter for the City of Brookhaven, the offices of Councilmembers for Posts 2 (two) and 4 (four) shall be elected on the Tuesday next following the first Monday in November, 2013.

The date of the Municipal Election for the Offices of Councilmember of Council Districts 2 (two) and 4 (four) is established to be Tuesday, November 5, 2013.

The qualifying fee for each council seat is $360.00 which is 3% of the total gross salary of the preceding year (Georgia Election Code 21-2-131). Each candidate shall file a notice of candidacy in the office of the City Clerk of Brookhaven, 200 Ashford Center North, Suite 150, Dunwoody, Georgia between Monday, August 26, 2013 and Wednesday, August 28, 2013, between the hours of 8:30am and 12:30pm, and 1:30pm and 4:30pm. Each candidate must meet the qualifications of the Charter and Code of the City of Brookhaven, as well as applicable State laws.
